Mobile time recording in the field

First, Corona raised the question 'How does working in my company work outside of my own four office walls?' and thus the topic of home office, drawing attention to location-independent time recording. Now, due to the BAG ruling in 2022, this topic is also becoming more important in field service. Recording working hours is not a new topic in many Cell Phone Number Database industries. Whether it's catering, building cleaning or the construction industry - in these areas, recording working hours has long been a mandatory part of everyday life. However, the Federal Labor Court's ruling from September 2022 makes it an issue in all areas.

Based on a ruling by the European Court of Justice in 2019, the Federal Labor Court requires all German companies to record the working hours of their employees . It stipulates that breaks and rest periods must also be recorded. This also includes companies whose employees do not traditionally work at a location or in an office.

Does time recording have to be done digitally?
Until now, the very industry-specific requirements for recording working hours were quite open and allowed a lot of flexibility. The ECJ's requirements, however, are much higher. The key points are reliability, objectivity and accessibility.

reliability
Pen and paper usually provide a simple and at first glance uncomplicated solution for time recording. The start and end of work, as well as breaks, are entered manually in pre-prepared tables and handed in to the boss at the end of the month. Unfortunately, this solution is not only often incorrect, but also easy to manipulate. The ECJ therefore stipulates that any changes to the recorded hours must be traceable .

objectivity
A second important point in the ECJ ruling is that all times must be recorded objectively. This means that manual additions days after the work has been carried out without agreement between those involved should be prevented. Implementing this requirement therefore requires an 'objective' recorder - ideally a digital tool.

accessibility
Every authorized party must have access to this data. This can be the works council, but of course also supervisory authorities as well as employees and employers themselves.
